Introduction

These Terms of Service ("Terms") govern the contractual relationship between Blackwell Masonry ("Company," "we," "our," or "us") and our clients ("Client," "you," or "your") for all masonry, parging, and related construction services. By engaging our services, you agree to be bound by these Terms.

Service Scope and Limitations

General Construction Conditions

Our masonry and parging services are performed with professional care and industry-standard practices. However, clients acknowledge that construction work inherently involves certain unavoidable conditions that may affect the surrounding environment.

Environmental Impact Limitations

Dust and Debris: Construction activities naturally generate dust and debris. We implement dust control measures where feasible; however, we cannot be held responsible for dust accumulation during normal construction operations.

Landscaping and Property Elements:

  • Minor impacts to grass and vegetation within two feet of the foundation work area are considered normal

  • Minor surface scratches to eavestroughs and aluminum siding may occur during standard operations

  • We exercise reasonable care to minimize damage to existing landscaping and structures

Protective Measures: We are committed to maintaining clean worksites and will implement reasonable protective measures, including the use of plywood, tarps, and other protective materials around work areas.

Specialized Service Conditions

Parging and Foundation Work

Foundation Movement Warranty Void: Our warranty becomes void if foundation movement occurs due to:

  • Excavation activities within 10 feet of the foundation

  • Natural foundation settling or movement

  • Ground vibrations caused by external construction activities

Such conditions are beyond our control and may result in hairline cracks or other surface irregularities.

Brick Repointing Services

Mortar Color Matching: While we strive for optimal color matching, we cannot guarantee exact replication of original mortar colors due to:

  • Age-related color variations in existing mortar

  • Natural variations in cement and sand materials

  • Environmental factors affecting mortar appearance over time

Dust Management: Brick repointing generates significant dust. We strongly recommend clients:

  • Close all windows and doors during work periods

  • Notify neighboring properties of scheduled work

  • Remove or cover sensitive items in work areas

Brick Removal and Installation

Underground Utilities: Clients are responsible for:

  • Identifying and marking all underground utilities before work commencement

  • Providing utility location services when required

  • Notifying the Company of any known utility locations

We are not liable for damage to unmarked utilities, including electrical cables, gas lines, or other underground services.

Metal Roofing Considerations

For projects involving work near metal roofing, we recommend engaging a qualified roofing contractor to temporarily remove metal sections in the work area. While we implement protective measures, we cannot guarantee prevention of minor dents or surface impacts to metal roofing materials during construction activities.

Force Majeure and Supply Chain

Due to circumstances beyond our control, including but not limited to:

  • Global pandemic conditions (such as COVID-19)

  • Supply chain disruptions

  • Material shortages

  • Transportation delays

Materials and supplies may experience availability issues, delays, or price fluctuations. We reserve the right to adjust project costs to reflect additional expenses incurred due to such circumstances.

Payment Terms and Conditions

Deposit Requirements

  • Residential Restoration Work: 25% deposit required

  • Commercial Projects: 50% deposit required

  • Work cannot commence until deposit payment is received and processed

Payment Schedule

  • Final payment of remaining balance is due within 14 days of project completion

  • Invoices will be issued prior to project start date

  • Late payments (after 28 days) will incur interest charges at 60% per annum on outstanding amounts

Cancellation Policy

Cancellation Fee: Projects cancelled within 14 days of scheduled start date will incur a $250 administrative fee to cover:

  • Scheduling coordination costs

  • Material ordering and preparation expenses

  • Administrative processing time

Warranties and Disclaimers

Limited Warranty

We warrant our workmanship against defects in materials and labor under normal conditions, subject to the limitations outlined in these Terms.

Warranty Exclusions

Warranties are void under conditions including but not limited to:

  • Foundation movement or settling

  • External excavation within 10 feet of work area

  • Modifications made by third parties

  • Normal wear and aging of materials

Limitation of Liability

Our liability is limited to the value of services provided. We are not responsible for:

  • Consequential or indirect damages

  • Lost profits or business interruption

  • Damages exceeding the contract value

Governing Law

These Terms are governed by the laws of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.

By signing our service agreement or authorizing work to commence, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
